Food Poisoning Compensation – Could You Make a Claim?

What is the law?

 

The Package Travel, Package Holidays and Package Tours Regulations 1992 are designed to protect consumers from different types of sickness contracted whilst on a package holiday. In the unfortunate event that any member of your group or party become sick, you may be entitled to pursue the travel operator for compensation which directly results from negligence.

 

Symptoms of food poisoning

 

If you become sick as a result of food consumed on your holiday, you will no doubt have some, if not all, of the following symptoms:

 

  • Stomach cramps
  • Diarrhoea
  • Dehydration
  • Fever
  • Vomiting
  • Abdominal pain
  • Muscle aches and pains
  • Shivering
  • Loss of appetite

Very often the symptoms of food poisoning can take a couple of days to appear and result in loss of days spent sick whilst on holiday. If this is the case, you may be entitled to compensation.

 

How does it occur?

 

Food poisoning can occur as a result of buffet food which is not completely fresh, insufficient food storage and a variety of other causes. Children and the elderly tend to suffer most but anyone can contract food poisoning whilst on holiday.

 

Limitations

 

There are time limitations to making a claim. Generally a claim can be made within three years of the incident.
