What’s involved in a compensation claim?
After you’ve had a look at the compensation calculator, you’ll need to speak to a specialist accident solicitor. This is often the part that puts people off, they have perceptions of ‘ambulance chasers’ and pushy solicitors forcing people into making a claim. At Zen Law Solicitors, we’re not like that at all! If you do want to go ahead with making a claim, we’ll need details of your injury, including how it’s affecting your mental health and day-to-day life. Your solicitor will then notify the other party that you’re making a claim via a Letter of Claim, and they then have 21 days to accept or deny responsibility (liability). If they deny liability – which is usually the case at first – your solicitor will work with you to gather evidence proving that they are at fault. That’s not to say that we won’t be doing the hard work though – we want you to focus on your recovery.
You’ll be kept up to date with the progress of your claim while your solicitor negotiates on your behalf. Most compensation claims are settled out of court, though in the unlikely scenario yours does go to court, your solicitor can advise you and even represent you. We can’t say how long your claim will take, as that depends on a number of factors like the complexity of the accident, number of parties involved and the responsiveness of those parties. But Zen Law Solicitors do everything possible to keep the claims process smooth and efficient.
If you win your claim, you’ll usually be paid by the other party’s insurance company. Each case is different, but claimants usually receive payment quite quickly, within 2-4 weeks of the claim being successful.
