Serious Injury Claims

A serious injury claim requires more than a simple valuation of pain and suffering. The legal team must understand how the injury affects the person’s independence, work, family life, care needs and future.

Building the evidence

Depending on the injury, evidence may be required from specialists in neurology, orthopaedics, neuropsychology, psychiatry, rehabilitation, care, occupational therapy, accommodation, prosthetics or other disciplines. Financial evidence may address past and future earnings, pensions, care, therapies, equipment, transport and accommodation.

Rehabilitation and interim payments

Where liability and the circumstances permit, early rehabilitation and interim payments can be important. The appropriate strategy depends on the evidence and procedural stage. We will consider immediate needs alongside the longer-term valuation of the claim.

Funding

Serious injury claims accepted by Zen are ordinarily funded under a Personal Injury CFA, with the current success fee capped at 25% inclusive of VAT of the relevant damages under the agreement.
