The arrangement for your matter

Pre-litigation Road Traffic Accident cases which fall within the Small Claims Track regime may be offered under Zen Law’s Pre-Issue Contingency Fee Agreement because legal costs are generally not recoverable from the compensator under that regime. Under the current agreement, Zen’s fee is 40% of compensation recovered, inclusive of VAT. The agreement covers pre-issue work only.

Road traffic injury claims which are not funded under that Small Claims Track CTFA are ordinarily dealt with under Zen Law’s Personal Injury Conditional Fee Agreement, with a success fee capped at 25% inclusive of VAT of the relevant damages in accordance with the agreement and applicable law.

We will tell you which arrangement applies before you instruct us. The signed funding agreement governs the individual case, including any responsibility for disbursements or insurance premiums.

Zen Law currently deals with accepted CICA matters under a Contingency Fee Agreement. Our fee is 36% of compensation recovered, inclusive of VAT. The individual agreement explains the scope of work, any responsibility for disbursements and what happens if no compensation is recovered.

Where Zen accepts a Housing Disrepair claim under its current Conditional Fee Agreement, the matter is dealt with on a No Win, No Fee basis subject to the agreement. If compensation is recovered, the Success Fee is the lower of 100% of Zen’s basic charges or 25% of the compensation defined in the agreement, inclusive of VAT. Zen absorbs any unrecovered shortfall in basic charges.

Zen will ordinarily fund reasonable disbursements needed to investigate and pursue the claim unless a different arrangement is agreed in writing. If proceedings become necessary, we will advise separately on costs protection and any proposed After the Event insurance. The signed CFA governs the individual matter.

These services are generally privately funded. Our Client Care Letter will set out the work we have agreed to undertake and the basis on which we will charge. Depending on the matter, this may involve a fixed fee, an agreed fee for a particular stage or time-spent charges. VAT and third-party disbursements may also be payable. We may ask for money on account before work begins or before third-party expenditure is incurred. If the scope changes materially, we will discuss the position and any revised estimate or additional fee with you wherever reasonably practicable.
